We are pleased to have shared our thoughts alongside Kenneth Pereira of Aldgate Chambers LLC in a presentation on ICO liability issues. Special thanks to Pooja Sinha of GLS Law Firm for hosting us and for her insightful contribution to the discussion.
While fsLAW and Aldgate Chambers LLC led the discussion, we found questions from the audience helped to deepen the analysis.
The upshot of the discussion was this – whether or not an ICO token is a security or utility token, whether or not it is regulated, there are rules which apply to ICOs which are useful to bear in mind. All these rules counsel in favour of taking greater care in preparing and documenting an ICO than is apparent from some ICOs conducted in the past.
